Our Core Mission Is To Help You Resolve Your Family Law Concern

Understanding Protective Orders in North Carolina

At Hopper Law Office in Raleigh, we represent clients who need protective orders or need their names cleared from allegations of domestic violence.

Our goal is to guide you through the legal aspects of a protective order case while reassuring you of ways in which the law can protect you.

What Is A Domestic Violence Protective Order (DVPO)?

A Domestic Violence Protective Order, also known as a DVPO or a “50B order,” is a legal safeguard for victims of domestic violence. This court-issued order enforces a clear boundary: the perpetrator must not come near the victim. Violation of a DVPO is taken seriously – law enforcement has the authority to arrest the violator immediately.

In our state of North Carolina, a “permanent” DVPO can be effective for up to one year and may be extended for up to two additional years upon renewal. At Hopper Law Office, we are committed to guiding you through the process of obtaining and renewing a DVPO when necessary. Alternatively, if you have been wrongly named in a DVPO, we will explore options for getting it lifted.

Eligibility For A DVPO

You may file for a DVPO if you have one of the following relationships with the perpetrator:

  • Spouse or ex-spouse
  • Someone you currently live with or have lived within the same household
  • A person with whom you share a child
  • A person of the opposite sex or a same-sex partner whom you’ve dated
  • A parent, child, grandparent, or grandchild

What if you don’t qualify for a DVPO? If you’ve been the victim of sexual assault or stalking by someone with whom you do not share a qualifying relationship for a DVPO, you can seek protection through a no-contact order, often referred to as a “50C order.”
