Differences Between Uncontested and Contested Divorces
In general there are two different types of divorces that may occur when two spouses decide to end their marriage. If the divorce is amicable and the spouses are able to cooperate with each other regarding the terms of their divorce they may utilize mediation, collaborative divorce or other forms of uncontested divorce.
An uncontested divorce is agreed upon by both spouses and, in general, the terms of the divorce can be decided upon without serious court litigation. In the event that the spouses are unable to resolve their differences long enough to cooperate on the terms of the divorce, a contested divorce will result. When a contested divorce occurs the two spouses will have to refer to a judge to decide the many factors regarding their divorce including
child custody,
spousal support and
property division.
